MEDIATION AND ARBITRATION
Because of the cost, delay, and lack of certainty of jury trials, more and more cases are being mediated and arbitrated in Indiana. Mediation is a confidential process of negotiation in which a neutral third party (the mediator) meets with parties to a dispute and attempts to help them reach an agreement that resolves their differences. Because they are less formal than court proceedings, mediation is frequently quicker and more cost effective than preparing a case for trial.
